On this Weeks of La Ley Con Jose 3-4-2017

En esta semana de La Ley Con José el sábado 4 de marzo de 2017, aquí están algunos puntos que fueron discutidos en el episodio de la semana pasada.

Conferencia con el congreso: El presidente Trump tuvo una conferencia con el congreso el pasado martes en la que expuso temas sobre inmigración, Obamacare, violencia y muchos otros. Trump incluso especuló que Obama tenía su teléfono conectado y estaba siendo espiado. José siente que Trump actuó como un presidente real con su discurso, pero al final del día, Trump todavía tweeted puntos negativos.

Deportación: Últimamente, las personas que tienen antecedentes penales muy menores han sido deportados sin causa real. Trump prometió que se deportarían a aquellos con graves antecedentes penales, pero lo que hemos estado viendo es que cualquier ofensa menor que comete una persona indocumentada está siendo enviada para ser deportada. Es por eso que todos tenemos que ser muy cuidadoso y si no somos indocumentados, luchamos por su gente.

DACA: Lo que vimos la semana pasada es que Daniella Vargas, una soñadora de Argentina, ha sido arrestada después de dar un discurso sobre la deportación de su familia. Este caso es interesante porque no envió su solicitud de renovación en el tiempo, por lo que la inmigración la arrestó. Es muy importante renovar a tiempo porque cualquier tipo de delito puede hacerle deportar, pero su caso es diferente porque vino a los Estados Unidos con una exención de visado, en la que 38 países pueden venir a los EE.UU. con sólo sus pasaportes y no No tienes tantos pasos a seguir, pero también cuando tienes este tipo de visa, no puedes luchar contra tu deportación. Los Estados Unidos tienen el derecho de deportarlo cuando quieran. José recomienda encarecidamente que envíe su solicitud DACA 150 días antes de la fecha de vencimiento para asegurarse de que todo pasa a través del tiempo.

José en Austin: José fue a Austin la semana pasada y habló con los delegados sobre todos los cambios que están por venir. Una de ellas es una propuesta en la cual las ciudades en Texas tienen que ayudar a la inmigración a buscar a personas indocumentadas o su financiamiento estatal es cancelado. Lo que José está tratando de hacer es votar en contra de esta propuesta que es la razón por la reunión. Muchos delegados están tratando de votar en contra. Lo que José piensa es que el diputado republicano no quiere necesariamente que esta propuesta pase, pero la gente en su área le está presionando para que vote por esta propuesta junto al gobernador. José fue a esta reunión para explicar su punto de vista al respecto. Las cosas siempre deben hacerse en un asunto civil ya veces se necesita una perspectiva diferente en este tipo de situaciones. José tuvo la oportunidad de hacerlo explicando su lado de un inmigrante y con suerte esto hará un cambio en la votación de la propuesta. Una cosa buena es que hay muchos diputados latinos que se asegurarán de que esta propuesta no pase y que esté luchando por nosotros.

Preguntas de los oyentes:

• “Tengo una hija que está bajo el acto de los sueños y ella está en la universidad para los deportes. Viaja a menudo debido a esto y la próxima semana tiene un juego en Nuevo Laredo donde hay un punto de control. ¿Debería dejarla ir?

Jose: tan principalmente la pregunta es, se le permite viajar y sí. Se le permite viajar a cualquier parte de los Estados Unidos. Ahora si su DACA es actual y no expirado, ella estará bien. Ahora tiene que tener mucho cuidado cuando vaya a Nuevo Laredo que no cruce la frontera.

• “En 2002 mi esposo y en 2003, la seguridad social le dio dinero a mis hijos, pero como su esposa no recibí nada. Dijeron que hasta cumplir los 60 años recibiría el pago “.

José: Por ley si el empleado que murió fue un residente o un ciudadano, los niños menores de 18 años y la esposa recibirá dinero. Si la esposa quiere recibir el dinero de la seguridad social, no puede casarse por la corte y recibirá el resto del dinero cuando cumpla los 60 años. Ahora, si la familia vive en México y no tiene visas, tendrá que cumplir En la frontera con un notario para hacer la solicitud para recibir los fondos y cada 6 meses tendrán que comprobar de nuevo para asegurarse de que su información está al día.

• “Abogado ¿cree que es un buen momento para presentar mi solicitud de residencia o ciudadanía en este momento?”

José: En mi opinión, creo que siempre es un buen momento; Especialmente si quieres ser ciudadano porque es muy difícil para el gobierno quitarlo. Ahora para una solicitud de residencia, asegúrese de hablar con un abogado primero para ver si habrá alguna complicación.

In this week of La Ley Con Jose Saturday, March 4, 2017, here are a few points that were discussed in this past week’s episode.

Conference with congress: President Trump had a conference with congress last Tuesday in which he brought up topics in immigration, Obamacare, violence, and many others. Trump even speculated that Obama had his phone wired and was being spied on. Jose feels that Trump did act like a real president with his speech but at the end of the day, Trump still tweeted negative points.

Deportation: Lately, people who have minor criminal records have been deported without real cause. Trump promised to have those with serious criminal records deported but what we have been seeing is that any minor offense an undocumented person does is being sent out for deportation. That is why we all have to be extra careful and if we are not undocumented, fight for your people.

DACA: What we have been seeing this past week is that Daniella Vargas, a dreamer from Argentina, has been arrested after she gave a speech on the deportation of her family. This case is interesting because she didn’t send out her renewal application in time which is why immigration arrested her. It’s very important to renew in time because any offense whatsoever can get you deported, but her case is a different one because she came to the US with a visa waiver, in which 38 countries can come to the US with just their passports and they don’t have so many steps to follow but also when you have this kind of visa, you cannot fight your deportation. The US has the right to deport you anytime they want. Jose highly recommends that you send out your DACA application 150 days before the expiration date to make sure it all goes through in time.

Jose’s meeting in Austin: Jose went to Austin this past week and spoke with delegates about all the changes that are to come. One of them is a proposal in which cities in Texas have to help immigration seek undocumented people or their state funding is canceled. What Jose is trying to do is vote against this proposal which is why the meeting was held. Many delegates are trying to vote against it. What Jose thinks is that the Republican deputy doesn’t necessarily want this proposal to pass but the people in his area are pressuring him to vote for this proposal alongside the governor. Jose went to this meeting to explain his point of view on the matter. Things should always be done in a civil matter and sometimes a different outlook is needed in these types of situations. Jose had the chance to do this by explaining his side of an immigrant and hopefully, this will make a change to the voting of the proposal.  One good thing is that there are many Latino deputies who will make sure this proposal doesn’t pass and who will be fighting for us.

Listeners Questions:

• “I have a daughter who is under the dream act and she is in college for sports. She travels often due to this and next week she has a game in Nuevo Laredo where there is a checkpoint. Should I let her go?”

Jose: so mainly the question is, is she allowed to travel and yes. She is allowed to travel anywhere in the US. Now if her DACA is current and not expired, she will be fine. Now she has to be very careful when she goes to Nuevo Laredo that she doesn’t cross the border whatsoever.

• “In 2002 my husband and in 2003, social security gave my children money but as his wife, I didn’t receive anything. They said until I turned 60 years I would receive payment.”

Jose: By law, if the employee who died was a resident or a citizen, children under the age of 18 and the wife will receive money. If the wife wants to receive the social security money, she cannot get married through court and will receive the rest of the money when she turns 60. Now if the family lives in Mexico and they don’t have visas, they will have to meet at the border with a notary to do the application to receive the funds and every 6 months they will have to check back to make sure their information is up to date.

• “Attorney, do you think it’s a good time to put in my residency application or citizenship right now?”

Jose: In my opinion, I think it’s always a good time; especially, if you want to be a citizen because it is very difficult for the government to take that away. Now for a residency application, make sure you speak with an attorney first to see if there will be any complications.
