Dream Act Update 2-18-2017

En esta semana de La Ley Con José  sábado 18 de febrero de 2017, aquí están algunos puntos que fueron discutidos en el episodio de la semana pasada.

The Dream Act: El presidente Trump hico una conferencia la semana pasada en la que respondió a algunas preguntas. El Dream Act fue traído a él y él no dio detalles exactos sobre lo que iba a pasar y que todavía estaban trabajando en él. Él no dijo sí o no en dejarlo caer, pero en el punto de vista de José, él siente que va a ser muy difícil para el programa que se quede. También escuchamos acerca de los dos casos de receptores de DACA que fueron arrestados; A pesar de que les dijeron a los oficiales que estaban protegidos bajo el Dream Act. Esta es la primera vez que un receptor del DACA ha sido arrestado y hecho público. Esto es muy importante saber porque esto podría suceder a cualquiera. La segunda persona arrestada fue encontrada con marihuana. Aunque esto no es un delito criminal significativo, el gobierno no lo toma a la ligera. José destaca que si usted está bajo la Ley de los Sueños, tenga mucho cuidado de no meterse en ningún problema con la ley. Incluso los delitos menores podrían hacerle deportar

Memorándum: La semana pasada se descubrió que el General John Kelly escribió un memorándum para presentar a las autoridades de inmigración y Trump sobre cómo manejar inmigrantes indocumentados. Una de sus soluciones fue enviar más de 100,000 soldados a la frontera y los estados para encontrar a todos los inmigrantes indocumentados y hacer que fueran deportados. Nunca en la historia el gobierno hizo que tantos soldados hicieran un trabajo como este. Permite, sin embargo, que los gobernadores de los estados decidan si quieren ejecutar esta propuesta en su estado. Por supuesto, cuando el documento se filtró, la Casa Blanca dijo que era falso y negó las acusaciones. No se ha firmado  ni se ha aprobado, pero José siente que esta es una posibilidad de que harán cualquier cosa para conseguir que muchos inmigrantes indocumentados sean deportados.

Ciudadanía: José recomienda encarecidamente que si usted es un residente para obtener su ciudadanía. Esto puede ayudarle extremadamente en el futuro. Sabe que mucha gente está preocupada por tomar el examen aunque debido a que su inglés no es fluido, pero si ha tenido su residencia por más de 20 años, puede tomar el examen en español o si tiene 55 años o más y tiene su residencia por lo menos 15 años, también puede tomar el examen en español. Si usted ha tenido su residencia por lo menos 5 años, ahora califica para ser un ciudadano.

Y como siempre, José aconseja que si eres arrestado o detenido NO firma nada. Tenga un plan y pide hablar con su abogado. Usted si tiene derechos.

Preguntas hechas por oyentes:

• “Mi pregunta para José es, el padre de un amigoa, que es un residente, regresaba a los Estados Unidos desde México y recibí una llamada telefónica que no estaban permitiendo que los residentes regresaran de México. Él no tiene antecedentes penales o algo así y me preguntaba es si usted ha sido informado sobre situaciones similares como esta? “

José: No he oído hablar de los residentes que no se les permite volver, pero yo necesito saber su historia de fondo. Además, inmigración tiene que decirle por qué no le están permitiendo volver. Si es un residente y vive en México, la inmigración es cada vez más estrictas a este tipo de situaciones, porque los residentes no están autorizados a vivir en cualquier lugar, excepto los EE.UU. Pero no he oído ni leído en ningún lugar que la inmigración no permite a los residentes regresar a los Estados Unidos desde México. Lo que recomiendo es que llame a mi oficina y me diga toda su información con su número de residente y haré todo lo posible para que regrese a los Estados Unidos de manera segura.

• “En 2016 renové mi tarjeta verde y todo salió bien. Me preguntaba, ¿estoy en peligro de que sea revocada? He tenido un DWI pero me encargé de él y hice toda la documentación que se necesitaba, pero ¿será difícil para mí regresar a los Estados Unidos si voy a visitar México? “

Jose: Esa es una buena pregunta. Inmigración no tiene derecho a retirar la residencia para un DWI. No importa si sólo has tenido uno o tres, no pueden quitarte tu residencia. Usted no tendrá ningún problema para regresar a los Estados Unidos, pero sí recomiendo que usted tome los documentos de la corte declarando que el DWI se ha cuidado de por si acaso.

• “Cuando alguien es arrestado por trabajar con un número falso y firma un documento de deportación voluntaria, ¿pueden seguir recibiendo estatus legal a través de su hijo de 21 años y ciudadano?”

Jose: Todo depende de los detalles. Si una persona que ha estado usando ese número falso lo ha estado usando por más de 6 meses y es arrestado por cualquier cosa, serán deportados y exiliados por 3 años, pero después pueden presentar una exención para recibir el estatus legal. Si regresan de nuevo a los Estados Unidos ilegalmente, eso se llama reingreso doble y no hay renuncia que permita el estatus legal incluso si usted tiene hijos, esposa, o esposo que es ciudadano.

• “Si mi padre me presentó una solicitud para que yo reciba un estatus legal, ¿puedo casarme y seguir recibiendo mis papeles?”

José: Si usted se casa por la corte antes de la fecha de prioridad y antes de recibir sus documentos, inmigración dejará su caso. Es por eso que recomiendo que no se casen por la corte todavía hasta recibir el estatus legal. Usted puede casarse a través de la iglesia, pero no por ley si desea recibir el estatus legal.

In this week of La Ley Con Jose Saturday February 18, 2017, here are a few points that were discussed in this past week’s episode.

The Dream Act: President Trump held a conference last week where he answered a few questions. The Dream Act was brought up to him and he didn’t give exact details on what was to happen to and that they were still working on it. He didn’t say yes or no on dropping it but in Jose’s point of view, he feels that it’s going to be very difficult for the program to stay. We also heard about the two cases of DACA recipients that were arrested; even though they told the officers they were protected under the Dream Act. This is the first time that a DACA recipient has been arrested and made publicly.  This is very important to know because this could happen to anyone. The second person that was arrested was found with marijuana. Though this is isn’t a significant criminal offense, the government does not take it lightly. Jose highlights that if you are under the Dream Act to be very careful to not get into any trouble with the law whatsoever. Even misdemeanors could get you deported.

Memorandum: This past week it was discovered that General John Kelly wrote a memo to present to immigration authorities and Trump on how to handle undocumented immigrants. One of his solutions was to send over 100,000 troops to the border and to the states to find all the undocumented immigrants and have them deported. Never in history has the government had so many soldiers do a job like this. It does allow though for the governors of the states to decide if they want to execute this proposal in their state. Of course when the document was leaked, the White House said it was false and denied the allegations. It has not been signed though nor been approved but Jose feels that this is a possibility that they will do anything to get as many undocumented immigrants deported.

Citizenship: Jose highly recommends that if you are a resident to get your citizenship. This can help you extremely in the future. He knows that a lot of people are worried about taking the exam though due to their English not being fluent but if you have had your residency for more than 20 years you can take the exam in Spanish or if you’re 55 and older and have had your residency for at least 15 years, you can also take it in Spanish. If you have had your residency at least 5 years, you now qualify to be a citizen.

And like always, Jose extremely advises that if you are arrested or detained NO NOT signed anything. Have a plan and ask to speak with your attorney. You do have rights.

Questions made my listeners:

• “My question for Jose is, a friend’s father, who is a resident, was coming back to the US from Mexico and I received a phone call that they weren’t allowing residents back in from Mexico. He doesn’t have a criminal record or anything and I was wondering if you’ve been informed about similar situations like this?”

Jose: I haven’t heard of residents not being allowed back in but I would need to know his background history. Also, immigration has to tell him why they are not allowing him back in. If he is a resident and lives in Mexico, immigration is becoming stricter to these type of situations because residents aren’t allowed to live anywhere but the US. But I have not heard or read anywhere that immigration is not allowing residents to return to the US from Mexico. What I recommend is to have him call my office and tell me all his information with his resident number and I will do everything possible to have him return to the US safely.

• “In 2016 I renewed my green card and everything came out okay. I was wondering, am I in any danger of getting it revoked? I’ve had a DWI but I took care of it and did all the documentation that was needed but will it be difficult for me to return to the US if I go visit Mexico?”

Jose: That is a good question. Immigration doesn’t have the right to take the residency away for a DWI. It doesn’t matter if you’ve only had one or three, they can’t take it away from you. You won’t have any trouble returning to the US but I do recommend that you take the court documents stating that the DWI has been taken care of just in case.

• “When someone is arrested due to working with a false number and they sign a voluntary deportation document can they still receive legal status through their child who is 21 and a citizen?”

Jose: It all depends on the details. If a person who has been using that false number has been using it for longer than 6 months and is arrested for anything, they will be deported and are exiled for 3 years but afterwards can file a waiver to receive legal status. If they return again to the US illegally, that is called double re-entry and there is no waiver allowing for legal status even if you have children or a spouse who is a citizen.

• “If my father put in an application for me to receive legal status by him, can I get married and still receive my papers?”

Jose: If you get married by court before the priority date and before receiving your documents, immigration will drop your case. That is why I recommend that you not get married by court just yet until receiving legal status. You can get married through the church but not by law if you want to receive legal status.
