Have an Action Plan! La Ley Con Jose 2/11/17

En esta semana de La Ley Con José el sábado 11 de Febrero de 2017, aquí están algunos puntos que fueron discutidos en el episodio de la semana pasada.

La Orden Ejecutiva: La orden que Trump firmó en Enero ha recibido muchos demanda, pero una demanda de ley muy significativa es una de Washington diciendo que era inhumana. Fue a la corte de apelaciones y tomaron la decisión de bloquear la orden. Podría tomar meses para que la Orden Ejecutiva caiga o se recupere ya que tiene que pasar por la Corte Suprema.

SB4 Propuesta: El Gobernador Abbot declara en esta propuesta que cada ciudad en Texas tiene que remover las ciudades del santuario. Si las ciudades no cooperan, no recibirán fondos estatales. Lo bueno es que tiene que pasar por la Cámara de Representantes de Texas y hay muchos demócratas que lucharán contra esta propuesta.

Llevar su residencia y ciudadanía: José recomienda que si usted es ciudadano o residencia de los Estados Unidos, debe llevar su pasaporte o tarjeta en todo momento, en caso de que un oficial lo solicite. Legalmente, usted necesita tener el documento original, pero José siente que por tener una copia será lo suficientemente bueno, ya que buscará su número. Además, si usted es residente y cambia su dirección, legalmente tiene 10 días para cambiar la dirección en su tarjeta de residencia y la solicitud se llama AS1 y puede descargarla en www.uscis.gov. Si está en el proceso de recibir un estatus aquí en los Estados Unidos, lleve sus documentos o recibos que demuestren que y se reúnen con su abogado para ver cómo está su caso desde que las leyes están siendo cambiadas.

Paquete de Plan de Emergencia: José ahora ofrece un plan de emergencia para los clientes y la comunidad. Es un plan de acción para ayudar a familias con padres indocumentados que están detenidos. José realmente recomienda que todos los que están en riesgo de ser detenidos, que tengan un plan de acción listo. El paquete le dirá lo que necesita hacer y cuánto cuesta si está detenido por inmigración. También organizará todos los documentos como certificados de nacimiento y sociales de los niños para facilitarlo en caso de que uno de los padres esté detenido. De esta manera todo será organizado y las familias no estarán en pánico sobre qué hacer. In this week of La Ley Con Jose Saturday January 30, 2017, here are a few points that were discussed in this past week’s episode.

The Executive Order: The order Trump signed in January has received many law suits but a very significant law suit is one from Washington saying that it was inhumane. It went to the appellate court and they made the decision to block the order. It could take months to have the The Executive order dropped or brought back up since it has to go through the Supreme Court.

SB4 Proposal: Governor Abbot states in this proposal that every city in Texas has to remove sanctuary cities. If the cities do not cooperate, they will not be receiving state funding. The good thing though is that it has to go through the Texas House of Representatives and there are many democrats who will fight this proposal.

Carrying your residency and citizenship: Jose recommends that if you are a US citizen or residence, to carry your passport or card at all times, just in case an officer asks for it. Legally, you need to have the original document but Jose feels that by having a copy will be good enough because they will look up your number. Also, if you are a resident and change your address, legally you have 10 days to change the address on your residency card and the application is called AS1 and you can download it on www.uscis.gov. If you are in the process of receiving a status here in the US, carry your documents or receipts proving that and meet with your attorney to see how your case is doing since laws are being changed.

Emergency Plan Package: Jose is now offering an emergency plan for clients and the community. It is an action plan to help families with undocumented parents who are detained. Jose really recommends that everyone who is in risk of being detained, to have an action plan ready. The package will tell you what you need to do and how much the cost is if you are detained by immigration. It will also organize all documents like birth certificates and socials from children to make it easier just in case if a parent(s) is detained. This way everything will be organized and families won’t be panicking on what to do. Once again he elaborated to NOT sign anything given by an immigration officer and tell them that you want to speak with your attorney first. You have rights.
