En esta semana de La Ley Con José de sábado 25 de marzo de 2017, aquí están algunos puntos que se discutieron en el episodio de la semana pasada.

 
Obamacare: El Partido Republicano tenía la intención de revocar Obamacare y reemplazarlo con un proyecto de ley respaldado por la Casa Blanca pero no consiguió suficiente apoyo y se derrumbó. La eliminación de Obamacare fue una parte importante de la campaña de Trump cuando se postulaba para la presidencia. Esto era algo que Trump discutido desde el primer día cuando él entró en oficina. Después de no conseguir quitar a Obamacare, Trump dijo que él pasaría a otros asuntos.

Qué hacer cuando la policía le toca su puerta

José consejo sobre qué hacer en caso de que un oficial de policía viene a su puerta.
Usted no está obligado a contestar la puerta. A menos que la policía tenga una orden de  cateo, o esté en libertad condicional, no es necesario que habrá la puerta o hablar  con ellos. Si no quieres responder a la puerta, no tienes que hacerlo. Usted tiene derechos.

Si usted quiere contestar la puerta y hablar con ellos el oficial de policía le dejará saber quién está buscando. Si el oficial está buscando a alguien que no conoce, informe al oficial. Si el oficial está buscando a alguien que usted sabe, asegúrese de decir la verdad.

Muchas veces, la policía le pedirá que entre. Frente a la autoridad y temeroso de parecer grosero, muchas personas permitan que la policía entre en sus hogares. Una vez adentro, la policía buscará cualquier cosa a simple vista que puede utilizar para justificar la obtención de una orden de cateo para su hogar.

No tienes que dejarlos entrar. Si un oficial de policía pregunta si pueden entrar, usted tiene el derecho de preguntar si tienen una orden de cateo. La única vez que un oficial de policía tiene el derecho de entrar en su casa es cuando tienen una orden de cateo o si usted les deja entrar.

Pregunta: “Mi esposa es ciudadana de los Estados Unidos, ¿puede solicitarme si tengo DWI?”

Respuesta: Un DWI no afecta su capacidad para legalizar su estado. No pueden negarte solo por un DWI .
Pregunta: “Tengo hijos ciudadanos estadounidenses, ¿puedo legalizar mi estatus a través de ellos?”

Respuesta: Los niños ciudadanos estadounidenses que tienen 21 años de edad o más pueden solicitar sus padres. Si su hijo tiene menos de 21 años no hay nada que pueda hacer en este momento.

In this week of La Ley Con Jose Saturday, March 25, 2017, here are a few points that were discussed in this past week’s episode.

Healthcare: The Republican Party intended to repeal Obamacare and replace it with a White House-backed bill but failed to get enough support and it collapsed. Removing Obamacare was a major part of Trump’s campaign when he was running for president. This was something Trump discussed from  day one when he entered into office. After failing to get Obamacare removed, Trump will move on to other issues.

What to Do When the Police Knocks On Your Door

Jose gives some tips on what to do in case a police officer comes knocking on your door looking for someone.

You aren’t required to answer the door. Unless the police have a search warrant, or you are on probation or parole but you are not required to speak with them. If you don’t want to answer the door, you have the right not to.

If you do want to answer the door and speak with them the police officer will let you know who they are looking for. If the officer is looking for someone you don’t know, let the officer know.  If the officer is looking for someone you do know, make sure to tell the truth.

Many times, police will ask to come inside. In the face of authority and afraid of seeming rude, many people will allow the police to come inside their homes. Once inside, the police will look for anything in plain sight they can then use to justify getting a search warrant for your home.

You do not have to let them inside. If a police officer asks if they can come inside, you have the right to ask if they have a search warrant. The only time a police officer has the right to enter your home is when they have search warrant or if you let them in the door.

Question:  “My wife is a US citizen, can she apply for me if I have DWI?”

Answer:  A DWI doesn’t affect your ability to legalize your status. You cannot be denied for just that alone.

Question: “I have US citizen children, can I legalize my status through them?”

Answer:  US citizen children that are of 21 years of age or older can apply for their parents. If your child is under 21 there is nothing you can do at the moment.
