La Ley Con Jose 1/30/2017

En esta semana de La Ley Con José el sábado 30 de enero 2017, estos son los puntos principales que se discutieron en el episodio de la semana pasada.

El Muro: Trump ha puesto un orden ejecutiva para tener un muro mas grande en la frontera de México y los Estados Unidos. José quiere que el público sepa, sin embargo, que no es fácil para un presidente construir un muro hasta ese extremo. Primero, el Congreso tiene que aprobarlo. Tienen que aprobar el presupuesto y aceptar pagarlo. En segundo lugar, si la pared se crea, no va a detener a los inmigrantes de entrar. Hay otras formas de entrar, como con una visa de turista. Trump también dijo que cobrará el 20% de las mercancías importadas de México. José recuerda a todos que ese dinero estaría saliendo de los bolsillos de los estadounidenses, no de México. Trump también dijo que cobrará por dinero extra que se envía a México, una vez más saliendo de los bolsillos de los estadounidenses o la gente en los EE.UU. Por último, incluso para construir este muro, Trump necesita el permiso de la tierra privada y propietarios de ranchos. Esto es algo que será muy difícil de conseguir aprobado. Además, para agregar más oficiales de inmigración, tomaría una buena cantidad de tiempo para entrenarlos y más dinero.

Ciudades del santuario: Trump ha declarado que todas las ciudades del santuario siguen la orden ejecutiva de la inmigración y entregan los inmigrantes a la policía. Si no, las ciudades no recibirán dinero federal. Afortunadamente, ciudades como Houston, Dallas y Chicago, el alcalde y la ciudad decidieron no seguir sus órdenes. Con esto , muchas personas están preocupadas de que el presidente llevará a cabo incursiones en las ciudades, pero José dice que no es probable. Costaría demasiado tiempo y dinero hacer una incursión. Pero si por alguna razón una incursión es para ser llevado a cabo, usted tiene el derecho de luchar contra su caso y no firmar la orden de documento de deportación. Jose énfasis a NO firmar nada y conseguir un abogado, usted tiene el derecho de quedarse y no decir nada.

DACA: En este tiempo,el DACA  no se hablado o  tocado, lo cual es una buena cosa, pero José sigue recomendando renovar su tarjeta antes de la fecha de vencimiento. Él recomienda renovarlo 160 días antes de la fecha de vencimiento.

Aplicaciones de inmigración en proceso: Casos que actualmente están en proceso como perdones, ciudadanía, residencia, etc, están bajo la corte federal. Trump no se permite tocar estos casos o detenerlos. Ahora si usted está aquí ilegalmente y usted califica para poner en una aplicación de la renuncia, haga eso ahora. Haciendo esto, usted puede permanecer en el país mientras que su aplicación está en proceso.

Trump Orden Ejecutiva sobre Inmigración: Trump ordenó este fin de semana una orden ejecutiva que restringe la inmigración de 7 diferentes países musulmanes, suspende la entrada de refugiados por 120 días, y los bares de todos los refugiados sirios por tiempo indefinido. Además, después de los 120 días, limitó el número de refugiados a 50.000, que es la mitad de lo que Obama tenía. En esta orden ejecutiva, también está haciendo más difícil la renovación de su visa.

Tenga un plan: Una vez más, José habla sobre la importancia de tener un plan si usted fue detenido por  inmigración. Recomienda tener un plan en el cual sus hijos serán atendidos, bienes y terrenos vendidos o puestos bajo el nombre de un miembro de la familia, tienen todos sus documentos juntos, y tienen dinero ahorrado para su familia y para la fianza de la inmigración. Para que sus hijos y la tierra sean atendidos, se reunirá con él o cualquier abogado para tener un testamento escrito con instrucciones y un notario, si usted fuera detenido por la inmigración. Es muy importante hacer un plan por si algo sucede.

Pregunta de oyente: “¿cuánto tiempo tengo disponible para contactar a mi familia si yo fuera detenido por ICE. Que es lo que pasa?”

– Lo que pasará es que te llevarán a la cárcel del condado y la cárcel llama ICE. Inmigración querrá hablar con usted primiero y lo que tendrá que responder  usted es: “Quiero luchar contra mi deportación, tengo familia aquí son los que son residentes y ciudadanos (si los tiene), no voy a firmar nada, y quiero hablar con mi abogado “. Cuando usted ha dicho esto, el oficial de inmigración tiene que estar de acuerdo y usted pagará una fianza de $ 5,000 y recibirá documentos que usted tiene que llenar para la fianza. Lo que hemos estado notando, es que todos  está siendo llevado a la cárcel en Dallas. Así que la fianza debe ser pagada en Dallas. Asegúrese de tener el dinero ahorrado y alguien para pagar

In this week of La Ley Con Jose Saturday January 30, 2017, these are the main points that were discussed in this past week’s episode.

The Wall: Trump has put in an executive order to have a wall build on the border of Mexico and the United States. Jose wants the public to know though that it isn’t easy for any president to just build a wall to that extreme. First, congress has to approve it. They have to approve the budget and agree to pay for it. Secondly, if the wall is created, it’s not going to stop immigrants from coming in. There are other ways of coming in, like with a tourist visa. Trump also said that he will charge 20% of imported goods from Mexico. Jose reminds everyone that that money would be coming out of Americans pockets, not Mexico. Trump also said that he will charge extra for money that’s sent to Mexico, once again coming out of the pockets of Americans or people in the US. Lastly, to even build this wall, Trump needs the permission of private land and ranch owners. This is something that will be very difficult to get approved. Also, to add more immigration officers, it would take a good amount of time to train them and more money.

Sanctuary cities:  Trump has declared that all sanctuary cities follow the immigration executive order and hand over immigrants to the police. If not, the cities will not be receiving federal money. Fortunately, cities like Houston, Dallas, and Chicago, the mayor and the city decided to still not follow his orders. With this being said, many people are worried that the president will carry out raids in the cities but Jose says it’s not likely. It would cost too much time and money to do a raid. But if for some reason a raid is to be carried out, you have the right to fight your case and not sign the order of deportation document. Jose emphasis to NOT sign anything and to get an attorney, you have the right to stay and not say anything.

DACA: So far The Dream act hasn’t been brought up or touched, which is a good thing but Jose still highly recommends renewing your card before the expiration date. He recommends renewing it 160 days before the expiration date.

Processing Immigration cases: Cases that are currently undergoing like waivers, citizenship, residency, etc. they are under the federal court. Trump isn’t allowed to touch these cases or stop them. Now if you are here illegally and you qualify to put in a waiver application, do that now. By doing this, you can stay in the country while your application is going through.

Trumps Executive Order on Immigration: Trump ordered this past weekend an executive order that restricts immigration from 7 different Muslim countries, suspends refugee entrance for 120 days, and bars all Syrian refugees indefinitely. Also, after the 120 days, he limited the number of refugees to 50,000 which is half of what Obama had. In this executive order, he also is making it more difficult to renew your visa.

Have a Plan: Once again, Jose talks about the importance of having a plan if you were to be detained by immigration. He recommends to have a plan in which your children will be taken care of, property and land sold or put under the name of a family member, have all your documents together, and have money saved up for your family and for bail from immigration. To have your children and land taken care of, meet with him or any attorney to have a will written up with instructions and a notary, if you were to be detained by immigration. It’s very important to make a plan just in case anything happens.

Listener question: “how much time do I have available to contact my family if I were to be detained by ICE. What happens?”

  • What will happen is, you will be taken to the county jail and the jail calls ICE. Immigration will want to speak to you and what you will have to respond is, “I want to fight my deportation, I have family here are who are residents and citizens (if you do), I will not sign anything, and I want to speak with my attorney.” When you have said this, the immigration officer has to agree and you will pay a $5,000 bail and receive documents that you have to fill out for bail. What we have been noticing, is that everyone is being taken to jail in Dallas. So bail must be paid in Dallas. Make sure you have the money saved up and someone to pay it.
